OnSale Homes Ltd (having a principal place of business at 255 McCraney Street West, Oakville, Ontario, Canada L6H3A9 (905-338-2083 ) provide the services offered on the OnSaleHomes.com, OnSale Homes Realty and OnSaleHomes.mobi subject to and under the following Terms and Conditions.

You must agree to these terms as a condition of using the services. By purchasing or using the services on onsalehomes.com you agree and acknowledge that you have read and understand the terms and agree to be bound by them, without limitation or qualification.

For Private Sellers

If you open an Account at OnSaleHomes.com, you accept responsibility for all activities that occur under your Account or password. We reserve the right to terminate your Account if individuals from more than one household access OnSaleHomes.com using any single user name or password. You are responsible for maintaining the confidentiality of your user name and password

You agree to pay all fees and any other charges in connection with your user name and password (including any taxes). All fees will be billed at the time you register (or as soon thereafter as fees or charges are incurred). You are responsible for all fees and charges incurred to access OnSaleHomes.com through an Internet access provider or other third party service.

In providing us with information during the registration process, you agree to provide true, accurate, and complete information and to maintain and update such information to keep it true, accurate, current. If any information you provide is untrue, inaccurate, not current or incomplete, or if we reasonably believe so, we may suspend or terminate your access. You acknowledge that you are over 18 years of age or otherwise are of legal age to form a binding contract. You are solely responsible for all acts or omissions that occur under your password, including the accuracy and completeness of all content that you submit, post or transmit through the Services. You agree and acknowledge that your use of the Web site and Services is to advertise your personal property or to find information related to the purchase or potential purchase by you of a home listed on OnSaleHomes.com, rather than as a commercial enterprise

Listing, Password, and Security. Customers are responsible for maintaining the confidentiality of their user names, listing numbers, and passwords. You are solely responsible for all activities that occur under your user name and password. As a Customer, you agree to immediately notify us of any unauthorized use of your user name and/or password. We cannot and will not be liable for any loss or damage arising from your failure to adequately safeguard your user name and/or password.

Cost: $69/mo

Refund Policy: A full refund for this plan is available if cancelled before signs are shipped. Cancellation must be made by emailing  accounts@onsalehomes.com.  Please include Name, Full Address and Contact #.

After signs have been shipped a full credit is available if you choose to use an OnSale Homes Ltd. referred real estate agents to successfully sell your home.An OnSale Homes Ltd. referred agent will credit you the Package price paid from any commission payable upon the successful sale of your home.Agent Referral and Commission Credit Adjustment Form can be requested by emailing agent.referrals@onsalehomes.com. Please include Name, Full Address and Contact #. This credit is subject to availability of qualified referred agents in your area.

Plan, Service or Product: Essential

Cost: $499

Refund Policy: A full refund for this plan is available if cancelled before signs are shipped. Cancellation must be made by emailing  accounts@onsalehomes.com.  Please include Name, Full Address and Contact #.

After signs have been shipped a full credit is available if you choose to use an OnSale Homes Ltd. referred real estate agents to successfully sell your home.An OnSale Homes Ltd. referred agent will credit you the Package price paid from any commission payable upon the successful sale of your home.Agent Referral and Commission Credit Adjustment Form can be requested by emailing agent.referrals@onsalehomes.com. Please include Name, Full Address and Contact #. This credit is subject to availability of qualified referred agents in your area.

Plan, Service or Product: Co-Op MLS Listing

Cost: $899

A full credit is available if you choose to upgrade to Full Service anytime in the sales process. An OnSale Homes Realty referred agent will credit you the Package price paid from any commission payable upon the successful sale of your home.

Plan, Service or Product: Full Service 

Cost: 1.5% of Sale Price (Payable on Closing)

Refund Policy: No refund policy is neccessary as there is no payment required until the successful sale of your home

Plan, Service or Product: Sign Package

Cost: $89

Refund Policy: A full refund for this plan is available if cancelled before signs are shipped. Cancellation must be made by emailing accounts@onsalehomes.com . Please include Name, Full Address and Contact #.

Plan, Service or Product: Upstage: Personalized Staging Report

Cost: $149.99

Refund Policy: A full refund for this service is available if cancelled before photos are reviewed. Cancellation must be made by emailing accounts@onsalehomes.com. Please include Name, Full Address and Contact #.

Plan, Service or Product: OnTarget Keywords Loaded for Google Adwords

Cost: $69.99

Refund Policy: There is no refund for this service

Plan, Service or Product: Offer Pre-Agreement

Cost: $7.99

OnSaleHomes.com or its affiliates may refer independent real estate professionals, brokers, or agents to you  through OnSale Homes Realty Brokerage; however, OnSaleHomes.com, does not itself engage in real estate broker services on your behalf.  In the event OnSale Homes Realty Brokerage must refer Realtor services to a third party, the terms of any agreement between a real estate broker/agent and you are not endorsed, recommended, or otherwise known by OnSaleHomes.com or OnSale Homes Realty.

OnSale Homes.Realty may receive payment including, but not limited, to a referral fee that may be a percentage of the commission received by a real estate agent/broker or mortgage broker involved in any real estate transaction. Any such payment to OnSale Homes Realty Brokerage is due to an agreement between OnSale Homes Realty Brokerage and the real estate broker/agent or mortgage broker involved. Your registration with OnSaleHomes.com or Listing with OnSale Homes Realty Brokerage, use of the Services, and agreement to the Terms constitutes your acknowledgment of, and agreement to, any such compensation arrangement.

Any dealings or communications you have through OnSaleHomes.com or OnSale Homes Realty Brokerage with any party other than OnSaleHomes.com and OnSale Homes Realty Brokerage are solely between you and that third party. Please review carefully that third party's policies and make sure you are comfortable with them before you engage their services

Consent to E-mail Communications from OnSaleHomes.com, As part of your marketing package OnSaleHomes.com will send you emails to help guide you through the process. In addition from time to time, we will send you e-mail announcements or correspondence on new features, products and services offered by OnSaleHomes.com, You can opt out of emails at anytime at unsubscribe@onsalehomes.com

User-Provided Information. By providing information to, communicating with, and/or placing material on, OnSaleHomes.com, you represent and warrant you own all necessary rights to the content you provide and in addition that all information you provide is true, accurate, current and complete. In addition you represent and warrant that the content will not cause injury to any person or entity; and if you post a property that you are the owner of the property with all rights, title, and interests in such property to list the property for sale.

You understand, acknowledge, and agree that we, in our sole discretion, may terminate your password, account (or any part thereof) or access to and use of the Services, and remove and discard any information posted by you on or through the Services, for any reason or no reason, with or without notice and effective immediately, including, without limitation, if we believe that you have violated or acted inconsistently with the letter or spirit of the Terms.

While OnSaleHomes.com, uses reasonable efforts to include accurate information, we make no warranties or representations as to the accuracy of the information available on the Web site and assume no liability or responsibility for any error or omission in such data or information.

ALL DISPUTES AND CLAIMS WITH ONSALE HOMES LTD. SHALL BE GOVERNED BY THE COURTS WITHIN THE PROVINCE OF ONTARIO, CANADA.
